PLANNING COMMISSION

BOARD OF APPEALS


ZONING BOARD OF APPEALS: meets first Tuesday

FORD COUNTY PLANNING COMMISSION: meets second Thursday

CONDITIONAL USE: granted by Zoning Board of Appeals upon recommendation of the Planning Commission after a public meeting (County Board not involved in conditional use process). A LESA study performed by the Soil & Water Conservation District (S&WCD) may be required when agricultural land is involved.

SPECIAL USE: Wind Energy Conversion System (see Appendix A of the Ford County Zoning Ordinance for detailed information)

VARIANCE & EXCEPTIONS: granted by the Zoning Board of Appeals after a public meeting (Planning Commission & County Board not involved in variance procedure). (See Variances and Exceptions handout)

ZONING ORDINANCE AMENDMENTS: zoning district change or text change
  • Planning Commission hears the amendment (2nd Thursday)
  • Zoning Board of Appeals conducts public hearing after receiving recommendation from the Planning Commission (1st Tuesday)
  • County Board approves or rejects (2nd Monday)
  • A LESA study performed by the Soil & Water Conservation District may be required when agricultural land is involved.
OPINION SURVEYS: required from neighbors on each side of the property and residents of the neighborhood and/or owners of property affected within 300 feet in villages and within 1½ miles in rural areas.

PUBLICATION:“Notice of Public Meeting” for Conditional Use and Variance and “Notice of Public Hearing” for Special Use and zoning amendments published in newspapers of general circulation in the county 15 days before the public meeting or hearing at the expense of the person requesting the Conditional Use, Special Use, Variance or zoning amendment

NON-REFUNDABLE FEES: $100.00 for Conditional Use, Special Use & zoning amendment or $75.00 for Variance in addition to fee for any required construction permits. S&WCD charges a fee for LESA study.
